On July 11, coinciding with the 20th Chinese Navigation Day, Nanjing Maritime Court, Jiangsu Provincial Department of Transportation, Jiangsu Maritime Safety Administration and other cooperative units, jointly held the meeting of promoting strategic cooperation on escorting the construction of "Water Transportation in Jiangsu" in Nanjing.
Since 2020, Nanjing Maritime Court has cooperated with Jiangsu Provincial Department of Transportation, Jiangsu Maritime Safety Administration, Lianyungang Maritime Safety Administration, Yangtze River Shipping Public Security Bureau of Ministry of Public Security, Jiangsu Provincial Department of Natural Resources, Jiangsu Provincial Department of Ecology and Environment, Jiangsu Provincial Department of Water Resources, Jiangsu Provincial Department of Agriculture and Rural Affairs, Jiangsu Station of Entry-Exit Border Inspection, Jiangsu Maritime Police Bureau, to promote the strategic cooperation of maritime justice and administrative law enforcement. At the meeting, 11 typical cases with Jiangsu characteristics and maritime characteristics in serving the overall situation, law enforcement, dispute resolution and social governance were released, which were formed by 11 cooperating units in the past five years.
In order to promote the construction of modernized water transportation system compatible with the high-quality development, the 11 cooperating units jointly agreed to put forward the Specific Measures on Further Strengthening the Cooperation of Maritime Justice and Administrative Law Enforcement on Guaranteeing the Construction of "Water Transportation in Jiangsu", which specifically included five parts.
1. Strengthening legal protection and serving the construction of water transportation infrastructure network
(1) Promote the construction of inland waterway networks in accordance with the law. Standardize and guide the construction of key projects to prevent and defuse legal risks.
(2) Work together to improve the level of port hubs. Actively respond to ports’ legal needs under new business models of construction of smart ports, cross-border e-commerce logistics, overseas warehouses, etc.
(3) Optimize the legal environment of the international maritime network. Explore to establish specialized law enforcement and judicial mechanisms for cases involving international shipping and China-Europe express trains.
2. Adhering to the lead of innovation and improving the service for water transportation
(1) Enhance the efficiency of water transportation. Support the convergence of multimodal transport document rules and service norms.
(2) Provide more efficient and convenient law enforcement and judicial services. Strengthen the promotion and application of smart maritime supervision system and the online intelligent platform.
(3) Support and protect the innovative development of the shipping industry. Promote the construction of regional shipping and logistics centers and actively respond to legal risks in the field of shipping finance.
(4) Ensure the healthy development of shipping entities. Strengthen administrative compliance guidance for small, medium and micro shipping enterprises to create a good environment for the large-scale development of shipping enterprises.
3. Upholding the green concept and promoting the sustainable development of water transportation
(1) Strengthen the legal protection of the ecological environment of water transportation. Work together to resolve disputes over environmental infringement and pollution. Deepen the pilot reform of "three-in-one" maritime trials.
(2) Support the standardized operation of smart and green ships. Strictly implement the mandatory scrapping mechanism for ships, and actively guide the application of high-tech ships.
4. Focusing on pluralistic co-governance and promoting the proper resolution of disputes involving water transportation
(1) Promote the upgrading of water multiple dispute resolution stations. Optimize the sites layout and enrich the power of resolution of disputes.
(2) Promote the substantive settlement of administrative disputes relating to water transportation. Establish a cross-regional and cross-departmental collaborative resolution mechanism to facilitate the resolution of administrative disputes.
(3) Prevent and defuse the risks relating to water transportation. Regularly carry out joint inventory, law enforcement, and improve emergency handling mechanisms such as shipwreck salvage and the seizure of hazardous chemicals vessels.
5. Strengthening the efficient coordination and improving the linkage mechanism of law enforcement and justice
(1) Improve the coordination mechanism of law enforcement and justice. Strengthen regular consultation, joint research, information sharing, and transfer of clues.
(2) Improve the mechanism of digital water transportation. Unblock the data barriers among transportation, port and waterway, fishery law enforcement, maritime law enforcement, border inspection and maritime justice.
(3) Improve the maritime credit supervision mechanism. Promote the sharing of maritime credit information in law enforcement and maritime justice, boosting the credit governance of shipping units.
