We, A Company, hereby confirms and authorizes B Company, to entrust lawyers on our behalf or handle with full power all the maritime & admiralty claims and legal matters of whatsoever nature and howsoever arising in court and/or other competent judicial institutions and administrations in the territory of the P.R.C.,the power of attorney includes but not limited to the following:
To file lawsuits or arbitration claims or administrative claims and objections or other claims as defined above,lodge objection to jurisdiction, apply for maritime injunctions, apply for measures for property preservation, apply for measures for evidence preservation and apply for enforcement and payment order, apply for fund of liability limitation for maritime claims;
1. To draft,prepare and submit all the relevant legal documents and sign and acknowledge various judicial service;
2. To attend hearings, pretrial meetings, trials and/or other meetings;
3. To respond, plead and defend;
4. To admit, waive and change the requests of the lawsuit and/or arbitration claims;
5. To conduct mediation or reconciliation ; to designate the bank account for receiving payment and to receive payment where necessary
6. To file counterclaims, appeals, complaints and/or apply for reconsideration etc.;
7. To lodge application for enforcedly execution of judgments or verdicts or mediation or arbitration awards or settlement agreements;
8. To appear and participate in the first, second legal proceedings and/or even the retrial or execution proceedings and/or other legal proceedings set out by law.
The general authorization letter has become effective from the date of execution and shall continue to be effective for 2 years during which we are entitled to revoke in written this general authorization letter with 1 month of prior notice.
In case a legal proceeding is still on when the period of validity expires, this general authorization letter shall survive till the end of aforesaid legal proceedings.
