Announcement of Jiangsu High People's Court on the Performance of Duties by Nanjing Maritime Court

In accordance with the Constitution of the People's Republic of China, the Organic Law of the People’s Courts of the People’s Republic of China, the Decision of the Standing Committee of the National People’s Congress on Establishing Maritime Courts in Coastal Cities, with being approved by State Commission of Public Sectors Reform and the consent of Supreme People’s Court of the People’s Republic of China, Nanjing Maritime Court is established under the law. The relevant matters are hereby announced as follows:

1. Nanjing Maritime Court shall begin to perform its statutory duties from December 4, 2019.

2. The jurisdiction of Nanjing Maritime Court covers the extended coastal waters from the junction of Jiangsu and Shandong to the junction of Jiangsu and Shanghai. The main and branch waterways of the Yangtze River from the junction of Jiangsu and Anhui to the estuary of Liuhe River, Jiangsu, and the harbors and seaward waterways in Jiangsu are covered in the jurisdiction as well.

3. In accordance with the Provisions of the Supreme Court on the Scope of Cases to Be Accepted by Maritime Courts, Nanjing Maritime Court hears 108 subdivided types of cases under 6 categories concerning maritime infringement disputes, maritime contract disputes, disputes related to utilization of oceans and seaward waterways and environment protection, other maritime affairs or commerce disputes, maritime administrative cases, and special maritime procedures.

4. Jiangsu High People's Court shall have the jurisdiction over appeals against judgments and orders of Nanjing Maritime Court.

5. Pursuant to the approval and notification requirements from the Supreme People’s Court, the Nanjing Maritime Court began to accept cases on December 4, 2019. After the said date, the Wuhan Maritime Court and the Shanghai Maritime Court shall not have the right to accept the cases which under the jurisdiction of the Nanjing Maritime Court. The cases accepted before the date shall not be transferred, and their appeal cases shall be accepted by Hubei High People’s Court and Shanghai High People’s Court respectively.
